Divorce question?

Coleman Deliberato: Not sure what a no -contest divorce is or may be in your state. I do know that after a year, in most cases one can file under abandonment of the marriage against the other spouse if spouse just up and leaves for no apparent reason. They person filing for abandonment can get a divorce degree with out the other person being there..Might you try to look it up under your state's divorce law....Show more

Jesse Pirieda: It would really depend on the situation. In general, if it is no contest, then both parties should sign.

Delmer Pectol: I'm not sure about your terms. In a no contest divorce, both parties sign. In a no consent divorce, it means, that one party has been served, the other has gone to court without the other showing up, the party not appearing in Court lost because the party that did show up put on proof of the grounds she/he had, or claimed he/she had for divorce. Also, in a no contest divorce, which is what I think you mean! , in most states both parties have to sign. It is called other things like "irreconcilable differences" so that it makes clear it is an agreed divorce. Some states let one person sign in this instance but not all. No consent divorce means you did not make it to a hearing and they decided for you. At least on the objective, that is what it sounds like.Good luck....Show more
